Terms of Service for Sunny

Please read these Terms of Service ("Terms") carefully before using Sunny ("the app"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. Use of the App

Sunny grants you a personal, non-transferable, non-exclusive license to use the app on devices you own or control, in accordance with these Terms and the Apple App Store Terms of Service.

2. Health and Safety Disclaimer

Sunny is not a medical device and does not provide medical advice.

UV index, safe-time, and tan estimates are approximations based on third-party weather data and general formulas. They may be inaccurate.
Sunny does not prevent sunburn, skin damage, or skin cancer.
You are responsible for your own sun safety. Always use appropriate sun protection.
Consult a qualified healthcare professional for any concerns about your skin or sun exposure.

You use Sunny's guidance at your own risk.

3. Subscriptions and Payments

Sunny's full features require an auto-renewing subscription. The plans are:

Sunny Yearly - 1 year, $49.99, with a 3-day free trial for eligible new users
Sunny Weekly - 1 week, $4.99
Sunny Yearly Offer - 1 year, $34.99, shown only as a one-time offer

Prices are in US dollars and may differ in other territories, where Apple converts to the local App Store price tier. The price shown in the app at the moment of purchase is the price that applies.

Payment is charged to your Apple ID account at confirmation of purchase.
The subscription automatically renews unless canceled at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours before the end of the current period.
You can manage or cancel your subscription in your Apple ID account settings.
If you cancel during the free trial, you will not be charged. Any unused portion of a free trial is forfeited when you purchase a subscription.
All purchases are handled by Apple. Refunds are subject to Apple's policies.

4. In-App Purchases and Virtual Items

The app includes virtual items (coins, accessories) that have no real-world monetary value, cannot be exchanged for cash, and are non-refundable except as required by law.

5. User Content

Photos and data you create in the app remain yours and stay on your device. You are responsible for the content you create using the app.

6. Acceptable Use

You agree not to:

Reverse engineer, decompile, or tamper with the app
Use the app for any unlawful purpose
Interfere with the app's security or intended operation

7. Intellectual Property

The app, including its design, mascot, artwork, and code, is owned by us and protected by intellectual property laws. You may not copy, distribute, or create derivative works without permission.

8. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the app will be error-free, uninterrupted, or accurate.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, including injury, skin damage, or loss of data, arising from your use of the app.

10. Termination

We may suspend or terminate your access to the app if you violate these Terms. You may stop using the app at any time by deleting it.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects changes. Continued use after changes means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of your country or state of residence, without regard to conflict of law principles.
